Terms of Service for PhotoG

I. Introduction

Before using the PhotoG platform, please read and fully understand the "Terms of Service for PhotoG" (hereinafter referred to as "these Terms"), which govern your use of the PhotoG platform and services.

If you have any doubts about the terms of the agreement, you can contact PhotoG customer service by emailing ceo@orannai.com. If you object to any of the terms, you can choose to stop using the PhotoG platform, as your use of the PhotoG platform will be deemed as acceptance and full agreement to all the contents of these Terms. If you are entering into this agreement on behalf of a company or other legal entity, the individual accepting these Terms represents and warrants that they have the authority to bind the entity and its affiliates to these Terms, and in such cases, "you" or "your" shall refer to the entity, its affiliates, and the users associated with it.

II. Use of Services

Our services include the use of artificial intelligence for product image generation and image processing, as well as product display and transactions. You may use our services for personal or commercial purposes, subject to the restrictions outlined in these Terms and Conditions.

  1. You must be at least 18 years old to use the service.
  2. You must provide a valid email address to complete the registration process.
  3. Your registration and use of the service must comply with all applicable laws and regulations. If you are an entity, organization, or company, the individual accepting these Terms represents and warrants that they have the authority to bind you to these Terms, and you agree to be bound by these Terms.
  4. You are responsible for maintaining the security of your account and password. PhotoG will not and cannot be held liable for any loss or damage resulting from your failure to comply with this security obligation.
  5. You are responsible for all content posted and activities that occur under your account (even if the content is posted by others who have accounts under your account).
  6. You may not use the service for any illegal or unauthorized purposes. You must not violate any laws in your jurisdiction when using the service (including, but not limited to, copyright or trademark laws).

III. User-Generated Content

  1. You are solely responsible for evaluating whether PhotoG and the images meet your needs, and you assume all risks associated with the use of the images you generate.
  2. You are fully responsible for any content you upload or submit to our website for processing or generation. You represent and warrant that you have all necessary rights to use and submit the content, and that the content does not violate any laws or infringe upon the rights of any third party.

IV. Intellectual Property

  1. All intellectual property rights in our website and services, including but not limited to copyrights, trademarks, and patents, are owned by PhotoG. You may not use our intellectual property without our prior written consent.
  2. There is no guarantee or warranty that the images generated by your use of the platform will not infringe upon the intellectual property rights of others.

V. Subscription and Refund

PhotoG offers a generous free version of the service for you to try before purchasing. Additionally, PhotoG allows you immediate access to and download of the content you generate. Therefore, when you make a purchase, you acknowledge the applicability of the service and waive your right to withdraw the purchase.

You can cancel your subscription at any time under "Profile" > "Manage Billing" in your account.

You will receive an email reminder 7 days before your subscription is renewed. If you do not cancel your subscription before it is renewed, the subscription renewal fee will be charged. Subscription renewal fees are non-refundable.

The refund policy is as follows:

  1. Refund within 7 days
    For orders within 7 days, if you have not generated any images, you can apply for a refund by contacting our customer service.
  2. Refund after 7 days
    For orders more than 7 days old, you may apply for a refund by contacting our customer service for the following valid reasons (we will assess the reasonableness and authenticity of the application, so refunds are not guaranteed in such cases):
    1. Our software has been malfunctioning for an extended period (more than 7 consecutive days).
    2. Duplicate purchases due to payment platform issues.
  3. Special cases not eligible for refunds
    1. Orders purchased through unofficial channels.
    2. Customers who have entered into specific contracts, subject to the terms of the contract.
    3. Orders that do not meet the refund conditions.
  4. Cancellation of membership and currency
    After the refund is completed, the corresponding membership will be canceled, and the subscribed currency will be returned.
  5. Refund processing time
    Under normal circumstances, we will process refunds within 3-7 working days. However, the actual refund time may vary depending on your payment method. Additionally, due to public holidays, the refund processing time may be longer than expected but generally will not exceed 20 days. If you have not received the refund within 20 days after your refund request is approved, please contact us to inquire about the refund status.

VI. Links to other websites

Our services may include links to third-party websites or services that are not owned or controlled by PhotoG. PhotoG has no control over the content, privacy policy, or practices of any third-party website or service and is not responsible for them. We do not endorse any of these entities/individuals or their websites' products. You acknowledge and agree that PhotoG is not directly or indirectly responsible for any damage or loss caused or alleged to be caused by the use or reliance on any such third-party websites or services or the content, goods, or services available on or through such third-party websites or services. We strongly recommend that you read the terms of service and privacy policy of any third-party website or service you visit.

VII. Limitation of liability

We are not responsible for any losses, including but not limited to direct, indirect, incidental, or consequential damages, resulting from your use of our website or services. We are also not liable for any losses resulting from the use or processing of user-generated content.

VIII. Indemnification

You agree to indemnify PhotoG and its affiliates, officers, directors, employees, and agents against any claims, damages, or expenses arising from your use or misuse of our website or services, or your violation of these terms and conditions.

IX. Termination

We may terminate your access to our website or services at any time if we believe you have violated these terms and conditions or any applicable laws or regulations, without notice or liability. If you wish to terminate your account, simply stop using the service. All provisions of these terms that are by their nature intended to survive termination shall survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitation of liability.

X. Governing Law and Jurisdiction

These terms and conditions are governed by the laws of the jurisdiction in which PhotoG is located. Any disputes arising from these terms and conditions will be resolved by the courts of that jurisdiction.

XI. Changes to these Terms and Conditions

PhotoG reserves the right to update and change the service terms at any time without notice. Any new features (including the release of new tools and resources) that enhance or augment the current service shall be subject to the service terms.
